Wrongful
Death
Wrongful death is death caused by the fault of another
either through negligence or by intentional act. Spouses,
children and parents can make the claim for damages.
In some cases, even though a person is deceased, his
or her estate may also have a claim for damages. Examples
of wrongful conduct that may lead to death include drinking
and driving, manufacturing a deficient product, building
an unstable structure or failing to diagnose a fatal
disease.
After
a wrongful death lawsuit, a portion of the judgment
is intended to compensate a plaintiff for having to
live without a deceased person. The compensation is
intended to cover the earnings and the emotional comfort
and support the deceased person would have provided.
A child might be entitled to compensation for the personal
loss of a parent as well as the amount of financial
support the child would have received from the now-dead
parent while a minor. A wife would recover damages for
loss of her husband's love and companionship and a lifetime
of expected support. A parent would be limited to damages
for loss of companionship but not support.
